39:4-129 Leaving Scene of Accident

  • 1st Offense:
    If injuries/death:
     $500 to $1,000 Fine; 1 yr. license suspension; up to 6 mos. jail; 8 points.
    If no injuries: $200 to $400 Fine; 6 mo. license suspension; up to 30 days jail; 2 points.

39:3-40 Driving While Suspended

  • 1st Offense: Up to 6 mo. license suspension; and $500 Fine
  • 2nd Offense: Up to 5 days Jail, Up to 6 mo. suspension; and $750 Fine
  • 3rd Offense: Mandatory 10 days Jail; Up to 6 mo. suspension; and $1000 fine

NOTE: If suspended for DWI or Refusal To Take Breath Test, the following additional penalties apply:   Additional $500 Fine; 1 to 2 yr. license suspension; and a minimum 10 days/maximum 90 days JAIL!

No Insurance, operating in School Zone or in accident with injuries, enhanced penalties may apply. Call for details.

39:4-50.2 Refusal of Breath Test

  • 1st Offense: 7 mo. license suspension; $300 fine
  • 2nd Offense: 2 yr. license suspension; and $500 Fine
  • 3rd Offense: 10 year license suspension; and $1000 Fine

NOTE:    A prior DWI enhances a subsequent Refusal. For example, if you get a DWI conviction and then sometime after that you get convicted of Refusal of Breath Test, the Refusal will be considered a 2nd offense!    But note that a prior refusal will NOT enhance a subsequent DWI.

39:6B-2 Driving With No Insurance

  • 1st Offense: $300-$1,000 Fine; Community Service; 1 yr. license suspension;
  • 2nd or Subsequent Offenses: Up to $5,000 Fine; Up to 14 days jail; 30 days Community Service; 2 yr. license suspension.
